Kausik (Allowed) CRM (M) 1538 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Salanpur Police Station Case No. 30/2022 dated 30.01.2022 under Sections 302/201/506/120B/34 of the Indian Penal Code, 1860. And In the matter of : Tapas Nath ……Petitioner. Mr. Ayan Bhattacharya, Sr. Adv. Mr. Kunal Ganguly ……for the Petitioner. Mr. Bhaskar Seth ……for the State. Learned advocate appearing for the petitioner submits that the petitioner is in custody for 4 years 6 months. Till date out of 36 witnesses 2 witnesses have been examined. Learned advocate for the State opposes the prayer for bail and submits that petitioner is the principal accused. I have taken into account the statements and I find that the case is based on circumstantial evidence. Petitioner is in custody for 4 years 6 months. As such, without entering into the merits of the case and only on the ground of detention and there being no possibility of trial being taken to its logical conclusion very soon, I am inclined to release the petitioner on bail. 2 Accordingly, Petitioner, namely, Tapas Nath shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each, one of whom must be local to the satisfaction of Learned CJM, Asansol, Paschim Bardhaman. If on bail, the petitioner shall be physically present on each and every date fixed before the learned Trial Court and shall not leave the jurisdiction of District of Paschim Bardhaman without the prior permission of the learned Trial Court. Accordingly, CRM (M) 1538 of 2026 is allowed. Memo of Evidence submitted be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
