ORAL ORDER Accused No.4 in Special Case No.94/2026, pending before the Court of Principal District and Sessions Judge, Mysuru, arising out of Crime No.125/2025 registered by Bantwala Rural Police Station, Dakshina Kannada District, for offences punishable under Sections 303(2), 307, 317(4) read with 3(5) of BNS, 2023; Sections 4 and 12 of the Karnataka Prevention of Cow Slaughter and Cattle Protection Act, 2020; Section 11(D) of the Prevention of Cruelty to Animals Act; and Sections 3(1)(ii), 3(4) and 3(5) of the Karnataka Control of Organized Crime Act, 2000, is before this Court in this petition filed under Section 483 of BNSS, 2023 seeking regular bail. 2. FIR in Crime No.125/2025 was registered by Bantwala Rural Police Station, Dakshina Kannada District for offences punishable under Section 303(2) of BNS, 2023, Sections 4 and 12 of Karnataka Prevention of Cow Slaughter and Cattle Prevention Act, 2020; and Section 11(D) of the Prevention of Cruelty to Animals Act, 1960, against unknown persons based on the first information dated 15.08.2025 received from Karthik son of Ananda Saliyan. During the course of investigation of the said case, the petitioner herein was arrested on 05.09.2025 and remanded to judicial custody. After completing the investigation, charge sheet is now filed against 4 persons for the aforesaid offences. The bail application filed by the petitioner before the Sessions Court in Special Case No.94/2026 was rejected on 02.06.2026. Therefore, he is before this Court. 4. The learned counsel for the petitioner having reiterated the grounds urged in the petition submits that the only allegation against the petitioner is that he had purchased beef from accused Nos.1 to 3, who allegedly had slaughtered

the cow belonging to the first informant. The petitioner had no criminal antecedents prior to he being arrested in the present case. After he was arrested in the present case, he is arraigned as an accused in Crime No.76/2025 registered for similar offences by Uppinangadi Police Station, Dakshina Kannada District. He accordingly, prays to allow the petition. 5.
Per contra, the Additional State Public Prosecutor, who has opposed the petition submits that the accused and petitioner appears to have transaction with others and he has purchased beef from them and some other stuff. She submits that the petitioner has been running a chicken stall from his garage without there being any license or permission for the same. Accordingly, she prays to dismiss the petition. 6. FIR was registered against unknown persons based on the first information received from Karthik son of Ananda Saliyan, who has alleged in his first information dated 15.08.2025 that his cow, which was left out for grazing had not come back home. During the course of searching the said cow, he had found the remains of his cow on the banks of Netravati river near Thumbe Bharat Agrovet field and it is under these

circumstances he had approached the police. During the course of investigation, accused Nos.1 to 3 were arrested and based on their confession statement, the petitioner was also arrested on 05.09.2025. As per the charge sheet allegations, accused Nos.1 to 3 had committed theft of the cow belonging to the first informant and had slaughtered the same in the aforesaid place and the meat was thereafter sold by them to accused No.4 for a sum of ₹20,000/-. 7. It is not in dispute that prior to the petitioner being arrested in the present case, he had no other criminal case registered against him and he is now arrayed as an accused in Crime No.76/2025 registered by Uppinangadi Police Station for similar offences after he was arrested in the present case. Therefore, I am of the opinion that the charge sheet lacks prima facie material against the petitioner for offence punishable under Section 111 of BNS, 2023 and for; the offences punishable under the provisions of Karnataka Control of Organized Crimes Act, 2000. The petitioner is in custody in the present case for the last more than 10 months. Investigation of the case is already completed.

8. Considering the aforesaid aspects of the matter, I am of the opinion that the prayer made by the petitioner for grant of regular bail needs to be answered affirmatively subject to appropriate conditions. Accordingly, the following:
ORDER The petition is allowed. The petitioner is directed to be enlarged on bail in Crime No.125/2025 registered by Bantwala Rural Police Station, Dakshina Kannada District, for offences punishable under Sections 303(2), 307, 317(4) read with 3(5) of the BNS, 2023; Sections 4 and 12 of the Karnataka Prevention of Cow Slaughter and Cattle Protection Act, 2020; Section 11(D) of the Prevention of Cruelty to Animals Act; and Sections 3(1)(ii), 3(4) and 3(5) of the Karnataka Control of Organized Crime Act, 2000, subject to the following conditions: a) The petitioner shall execute a personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court;
b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the

Trial Court exempts his appearance for valid reasons;
c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses;
d) The petitioner shall not involve in similar offences in future;
e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is
disposed off.
