27.07.2026 Serial no. 5 [G.S.D] CRM (M) 1165 of 2026 In re : An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/under Section 483 of the BNSS, 2023 in connection with Pre-trial case no. 403 of 2025 arising out of Special Case No. 72 of 2025 vide Manikchak PS Case No. 276 of 2025 dated 22.04.2025 u/s 65(1) of the BNS, 2023 read with Section 4 of the POCSO Act. -And- In the matter of : Charan Mandal … Petitioner(s) Ms. Sujata Das … for the Petitioner(s) Mr. Kaustav Lal Mukherjee … for the State-respondent(s) The learned advocate for the petitioner submits that the petitioner is in custody for one year three months; the deposition of the victim has already been completed before the learned Special Court, as such, he prays that the petitioner may be released on bail. Learned advocate for the Sate opposes the prayer for bail. I have taken into account the deposition of the victim before the learned Magistrate and I find that the victim has been consistent in her version. Having considered the same, at this stage, I am not inclined to release the petitioner on bail. 2 Hence, the prayer for bail of the petitioner is Rejected. However, the learned trial court is directed to expedite the trial of the case in view of the detention of the present petitioner. Accordingly, CRM (M) 1165 of 2026 is dismissed. Report and the Memo of Evidence submitted be kept with the record. Parties to act on a server copy of this order duly collected from the official website of the Hon’ble High Court, Calcutta.
