27/07/2026 D/L – 1295 Court No.35 S. Kundu Allowed C.R.M.(M) 1205 of 2026 In Re: An application for bail under Section 483 of the BNSS, 2023. In connection with Kotwali P.S Case No. 1398 of 2025 dated 19/12/2025 under Sections 4 of the POCSO Act and Sections 9 and 11 of the Prohibition of Child Marriage Act and Section 75 of the Juvenile Justice (Care and Protection of Children) Act. In the matter of: XXX …Petitioner. Mr. Sumanta Das …for the petitioner. Mr. Koustav Lal Mukherjee …for the State. Learned advocate appearing for the petitioner submits that the petitioner is in custody for about 142 days. Charge sheet has already been submitted before the jurisdictional Court and the other materials of the case do not warrant further detention of the petitioner. Learned advocate for the State opposes the prayer for bail. I have taken into account the statement of the victim before the learned Judicial Magistrate under Section 183 of the BNSS. Having considered the same, I am of the opinion that further detention of the present petitioner is unwarranted. As such, the prayer for bail of the petitioner is allowed. 2 Accordingly, the petitioner shall be released on bail upon furnishing a bond of Rs.20,000/- with two sureties of Rs.10,000/- each, one of whom must be local to the satisfaction of learned Judge, POCSO Act, Krishnagar, Nadia. If on bail, the petitioner shall be physically present on each and every date fixed before the learned Court and shall not leave the jurisdiction of District Nadia without the prior permission of the learned Court. Accordingly, CRM (M) 1205 of 2026 is allowed. All parties shall act on the basis of the server copy of this order duly downloaded from the official website of this Court. (Tirthankar Ghosh, J.)
