The petitioner is apprehending his arrest in connection with Pratappur P.S. Case No. 102 of 2025, registered for the offence under Sections 15 and 18 of the NDPS Act of Bhartiya Nyaya Sanhita, 2023, pending in the court of learned Sessions Judge – cum – Special Judge, NDPS Case, Chatra. 3. Learned counsel appearing for the petitioner submits that the petitioner was not present on the spot however, the allegations are made that from the motorcycle of the petitioner, 10 Kg. of poppy straw has been recovered. He submits that the said quantity is intermediary. He also submits that the petitioner is not having criminal antecedent as disclosed in para 14 of the petition. 4. Learned A.P.P. appearing for the State has opposed the prayer and submits that from the motorcycle of the petitioner the said poppy straw has been recovered. 5. Considering that the said quantity is intermediary and the petitioner is not having criminal antecedent as disclosed in para 14 of the petition and in that view of the matter, the petitioner, named above, is directed to surrender before the learned Court within two weeks from today and the learned Court shall release the petitioner on such terms and conditions or the sureties as the learned Court may deem fit and proper.
