……for the State. Learned advocate appearing for the petitioner submits that the petitioner has been implicated in the instant case after the breaking up of a relationship. Learned advocate appearing for the de-facto complainant opposes the prayer for bail and submits that petitioner has been continuously threatening, there are Whatsapp messages and petitioner knowingly is abusing the process of law Learned advocate appearing for the State has produced the Case Diary, the statement of the witnesses along with the statement of the victim under Section 183 of the BNSS. I have taken into account the allegations and the progress of the investigation, particularly, the initial accusations made under Section 175(3) of the BNSS. Having regard to the overall
2 circumstances which is the background of the present case, I am of the view that custodial detention of the present petitioner is unwarranted. As such, prayer for anticipatory bail of the petitioner namely, Hajrat Ali @ Hajrat Sk is allowed. Accordingly, I direct that in the event of arrest, the petitioner shall furnish bond subject to the satisfaction of the investigating officer/arresting officer of the case and also subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and/or under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. As, the investigation of the case is in progress, petitioner shall make himself available before the investigating officer within a period of 10 days from date, the investigating officer of the case will fix future dates, if required, for the purposes of the investigation of the case. With the aforesaid observations, CRM (A) 2040 of 2026 is allowed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
