Mr. Sabir Ahmed, Mr. Shraman Sarkar, Mr. Dhiman Banerjee, Mr. Quazi Ezaz Ahmed …for the petitioners The petitioners herein are aggrieved with the orders dated 28.03.2024 and 12.12.2025 by which warrant of arrest was issued against the present petitioners. Being aggrieved by the aforesaid orders, learned Counsel for the petitioners, Mr. Ahmed, submits that the petitioners had taken proper steps on that date disclosing the reason of their failure to attend the Court physically but the Trial Court whimsically rejected the said prayer and had issued warrant of arrest against the petitioners, without following the procedure laid down in the law. However, learned Counsel for the petitioners prays for giving liberty to the petitioners to surrender before the Court below. Having heard learned Counsel for the petitioners and that the prayer made by the petitioners is innocuous, let CRR 2874 of 2026 be hereby disposed of by giving liberty to the petitioners to surrender before the Court below within four weeks and in event of such surrender, the Court below will dispose of their prayer in accordance with law. 2 The impugned orders dated 28.03.2024 and 12.12.2025 by which the warrant of arrest was issued against the petitioners shall remain stayed for a period of four weeks or till the petitioners surrender before the Court below, whichever is earlier.
