As per the office report, service upon the Respondent is stated to be secondary. However, the report submitted by the Nazarat, District Court, Udham Singh Nagar, reveals that notices were duly served upon the wife of the Respondent. The report specifically records that the wife of the Respondent- Komal Charan S/o Shri Ram Prasad, has received the summons physically, and her thumb impression is annexed to the receipt. 3. In view of the aforesaid, the service upon the Respondent is held to be sufficient. 4. Despite sufficient service, none has appeared on behalf of the Respondent. 5. The Trial Court Record has been received and is taken on record. 6. The matter requires consideration. 7. Upon perusal of the record, this Court finds that sufficient grounds exist for granting leave to appeal. Accordingly, leave to appeal is granted. 8. Objections, if any, be filed by the Respondent. 9.
