D/L623 28.07.2026 Bpg. C.R.M. (A) 1175 of 2026 In Re: An application for Anticipatory Bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 filed in connection with Entally Police Station Case No.293 of 2025 dated 24.11.2025 under Sections 318(4)/336(2)/336(3)/338/340(2)/351(2)/61(2) of the Bharatiya Nyaya Sanhita, 2023; Omar Farooque & Anr. Versus The State of West Bengal Mr. Anirban Dutta Mr. Arka Ghosh. …for the petitioners. Mr. Krishnendu Bhattacharya Mr. Koustav Lal Mukherjee. …for the State. Mr. Ayan Bhattacherjee Ms. Drapti Gandhi Mr. Mazhar Hossain Chowdhury Ms. Ayesha Sultana. …for the de facto complainant. Mr. Krishnendu Bhattacharya learned Additional Public Prosecutor along with Mr. Koustav Lal Mukherjee, learned advocate, appears on behalf of the State. Their appointment may be regularized by the concerned authorities. Learned advocate appearing for the petitioners submits that the petitioners are innocent and have been falsely implicated in the instant case. Learned Additional Public Prosecutor opposes the prayer 2 for anticipatory bail and submits that the investigation of the case is in progress and custodial detention of the present petitioners are required for assessing regarding the contentions made. It has further been pointed out that an octogenarian lady has been allured and deceived by the present petitioners. Having considered the manner in which the deception has taken place, I am not inclined to extend the relief of anticipatory bail. Accordingly, CRM(A)1175 of 2026 is dismissed. Interim order, if any, is vacated. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities. (Tirthankar Ghosh, J.)
