Learned advocate appearing for the petitioner submits that the petitioner is in custody for more than 2 years and till date out of 15 witnesses cited by the prosecution 3 witnesses have been examined.
Learned advocate for the State opposes the prayer for bail. Records of the case reflect that victim and two other witnesses have been examined.
I have taken into account the statement of the victim under Section 183 of the BNSS. Having considered the overall circumstances, I am inclined to release the petitioner on bail.
2 Accordingly, Petitioner, namely, Alfaj Sk @ Sekh shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each, one of whom must be local to the satisfaction of Learned Special Court (POCSO), Tehatta, Nadia. If on bail, the petitioner shall be physically present on each and every date fixed before the learned Trial Court and shall not leave the jurisdiction of District of Nadia without the prior permission of the learned Special Court.
Additionally, petitioner shall not enter into the jurisdiction of Tehatta Police Station till further orders of this Court.
Accordingly, CRM (M) 1537 of 2026 is allowed.
Report submitted by the State relating to the service effected upon the private opposite party be kept with the record.
All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
