Learned advocate appearing for the petitioner submits that earlier on 2.2.2026 there was a direction in CRM (NDPS) 1692 of 2025 to approach this Court after the evidence of the seizure list witnesses are over. There was also specific direction upon the trial court to exhaust the process of law to split up the trial and proceed with the case as expeditiously as possible. Till date, the trial of the case has not been split up. Learned advocate appearing for the State opposes the prayer for bail and submits that some time be granted. Petitioner was arrested on 30th November, 2024 and since then he is in custody. Charge sheet reflects that the prosecution has relied upon 20 witnesses in order to prove its case. Having considered the period of detention of the petitioner and there is no possibility of the trial commencing

as the other accused is being traced out by the prosecution, I am of the opinion that further detention of the petitioner is immaterial. Thus, prayer for bail of the petitioner is allowed. Accordingly, the petitioner shall be released on bail upon furnishing a bond of Rs.20,000/- with two sureties of Rs.10,000/- each, one of whom must be local to the satisfaction of learned Special Court, NDPS Act, 2nd Court, Behrampore, Murshidabad. If on bail, the petitioner shall be physically present on each and every date fixed before the learned Trial Court and shall not leave the jurisdiction of District Murshidabad without the prior permission of the learned Special Court. Accordingly, CRM (NDPS) 914 of 2026 is allowed. Memo of evidence filed by the State is taken on record. All parties shall act on the basis of the server copy of this order duly downloaded from the official website of this Court.
