Learned counsel for the petitioner is present. He has served notice on the Trial Court advocate on 22.04.2026 and filed a memo to that effect on 28.04.2026. In spite of service of notice, neither the respondent nor his advocate turned up before the Court.
2. Heard the arguments of learned counsel for the petitioner.
3. This Civil Petition is filed by the petitioner/wife for transfer of G & WC No.15/2025 filed by the husband for guardianship of the minor daughters before the Senior Civil Judge and JMFC, Kushtagi to the Court of IV Additional Principal Judge, Family Court, Bengaluru.

Learned counsel for the petitioner stated that the petitioner is residing in Bangalore along with her mother and brothers and is dependent on them. She has two minor children, aged 14 and 10 years and they are studying in the 9th and 4th standards respectively, at Bangalore. The marriage between the petitioner and respondent was solemnized on
27.12.2010. The petitioner filed a complaint in Crime No.82/2024 before the Women Police Station, North Division, Bengaluru, for the offences punishable under Sections 498A, 506 and 34 of the IPC and also Sections 3 and 4 of the D.P. Act. The respondent/husband was also working in Bengaluru. The respondent filed M.C.No.68/2024 under Section 9 of the Hindu Marriage Act, for restitution of conjugal rights. The said petition was transferred to the IV Additional Principal Judge, Family Court, Bangalore, in Civil Petition No.13/2025 dated
12.03.2025. The distance between Kushtagi and Bangalore is 385 kilometres and it is difficult for the petitioner to travel all the way with minor children. Therefore, considering the
arguments of learned counsel for petitioner and in the absence of respondent arguments, this Court finds that it is just and

reasonable to transfer G&WC No.15/2025 from Senior Civil Judge and JMFC, Kushtagi to the Court of IV Additional Principal Judge, Family Court, Bengaluru. Accordingly, the Civil Petition is allowed.
