27.07.2026 Serial no. 3 [G.S.D] CRM (A) 880 of 2026 In re : An Application under Section 482 of the BNSS, 2023/under Section 438 of the Cr.P.C. in connection with Kulti PS Case No. 709 of 2025 dated 26.12.2025, pre-Trial case no. 1/2026, renumbered as 17/2026 u/s 69/108/318(1)/3(5) of the BNS and Sections 4(6) of the POCSO Act. -And- In the matter of : Mamata Adhikari @ Mamta Adhikari &Anr. … Petitioner(s) Mr. Apurba Kumar Datta … for the petitioner(s) Mr. Subhasish Pachhal Mr. Soumalya Dutta … for the State-respondent(s) Learned advocate for the petitioners submits that the petitioner no.1 is the mother of the petitioner no.2. The petitioner was 2 was having a relationship with the deceased. However, after certain point of time, the petitioner no.2 disowned the relationship with the deceased; ignored her and the deceased was abused with filthy and abusive languages were hurled both by the family members as also the petitioner no.2 which led to the deceased to end her life. Having regard to the overall circumstances of the case and the prayer advanced, I am inclined to allow the 2 prayer for anticipatory bail of the petitioner no.1 and reject the prayer for anticipatory bail of the petitioner no.2. Hence, the prayer for anticipatory bail of the petitioner no.1 [Mamata Adhikari @ Mamta Adhikari] is Allowed. Accordingly, I direct that in the event of arrest, the petitioner no.1 [Mamata Adhikari @ Mamta Adhikari] be released on bail upon furnishing bond of Rs.20,000/-(Rupees Twenty Thousand only), with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local, to the satisfaction of the arresting officer of the case and also subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and/or under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. So far as the petitioner no.2 is concerned, his prayer for anticipatory bail is Rejected. As charge-sheet has been submitted, this order of Anticipatory Bail will remain in force for a period of six weeks. Accordingly, CRM (A) 880 of 2026 is Partly Allowed. Report and the Memo of Evidence submitted be kept with the record.
