1. The matter comes up on an application moved by the applicant in the year 2016, alleging a willful and deliberate breach of the conditional consent order dated 30.05.2014 passed by the Coordinate Bench of this Court.

Learned counsel appearing on behalf of respondent No.5 submits that in compliance with the directions encapsulated in the
[2026:RJ-JP:17431] (2 of 2) [WMAP-278/2014] aforesaid order dated 30.05.2014, an appropriate application seeking the merger of the entire subject plot was duly filed before the Municipal Council, Sikar.
3. It is further submitted that the said merger application was subsequently approved by the competent authority and following the same, construction project comprising a four-story building has already been completed.
4. It is next submitted by respondent No.5 that the order dated 30.05.2014 has been fully complied with in letter and spirit, and absolutely no breach survives as on date.

Learned counsel for the applicant has not refuted the aforesaid factual submissions and subsequent developments brought on record by the learned counsel for respondent No.5.

Having heard the submissions advanced by the learned counsel and taking note of the undisputed factual position regarding the compliance of the order dated 30.05.2014, this Court observes that the grievance of the applicant stands addressed and no substantive lis remains to be adjudicated in the present matter.
7. Accordingly, the present application stands disposed of.
8. It is made clear that if the facts stated before this Court is found to be otherwise, the parties shall be at full liberty to move an appropriate application for revival of the proceedings, strictly in accordance with the law.
