Mr. G.Maheswara Rao, the learned counsel for the Petitioner, submits that the Petitioner is innocent of the alleged offence and he has been falsely implicated in the alleged offence. He has not committed any offence. He is law-abiding citizen. He has got fixed abode. The Petitioner undertakes to abide by any conditions that this Court may impose while granting bail to the Petitioner. Therefore, he prays that the present petition be allowed. 3. Per contra, Ms.P.Akhila Naidu, learned Assistant Public Prosecutor, vehemently opposed the grant of bail to the petitioner. It is further submitted that though the charge sheet has been filed, the allegations levelled against the petitioner are grave in nature. It is contended that, if the petitioner is released on bail, there is every 3 Dr.YLR,J Crl.P.No.4617 of 2026 Dated 16.06.2026 likelihood of his influencing the prosecution witnesses and interfering with the course of the trial. The petitioner is alleged to have indulged in the possession and transportation of a commercial quantity of ganja. Hence, it is urged to dismiss the petition. 4. Heard the learned counsel for the petitioner and the learned Assistant Public Prosecutor. Perused the record. 5. As seen from the record, the petitioner/Accused No.3 was arrested pursuant to the execution of a Non-Bailable Warrant (NBW) on 03.01.2026. Ever since, he has been in judicial custody for the past 166 days. The role of the petitioner came to light based on the confession of Accused Nos.1 and 2. The seized contraband is 61.00 Kgs of ganja, which is a commercial quantity. Though the investigation has been completed and the charge sheet has been filed, which was numbered as N.S.C. No.280 of 2025, the request for enlarging the petitioner on bail at this juncture is not found convincing or reasonable, inasmuch as the petitioner was arrested pursuant to the execution of a Non-Bailable Warrant and there is every likelihood that he may not be available for trial if enlarged on bail. 6. Having regard to the entire facts and circumstances of the case and the nature and gravity of the allegations levelled against the 4 Dr.YLR,J Crl.P.No.4617 of 2026 Dated 16.06.2026 petitioner, this Court is not inclined to enlarge the petitioner on bail at this juncture. Accordingly, this Criminal Petition is liable to be dismissed. 7. In the result, the Criminal Petition is dismissed.
