2 restoration application (MCC) is condoned. 3) Also heard on application for restoration of MAC No.303 of 2025 which was dismissed vide order dated 05.02.2025. 4)
Learned counsel for the applicant would submit that the applicant could not deposit the security/mandatory amount of Rs.25,000/- at the time of filing of MAC No.303 of 2025. He would further submit that subsequently, the said amount has been deposited and, therefore, this application may be allowed and MAC No.303 of 2025 may be restored to its original number. 5) On the other hand, learned counsel appearing for Non-applicant No.4 would oppose the submissions. 6) Heard. 7) Having considered the fact that the security amount of Rs.25,000/- was not deposited along with the memo of appeal, whereas it is mandatory on the part of the owner of the vehicle to deposit the sum of Rs.25,000/-. As the mandatory amount was not deposited by the applicant herein, owner of the vehicle, therefore, MAC No.303 of 2025 was dismissed. I do not find any good ground to interfere with the order passed in MAC No.303 of 2025. Accordingly, this MCC fails and is hereby dismissed. Sd/- Rakesh Mohan Pandey JUDGE Rekha
