Respondent(s) For Petitioner(s) : Mr. Curtis Collins, Advocate For Respondent(s) : Mr. Ramakant Mishra, DSGI MADHURIMA THAKUR Digitally signed by MADHURIMA THAKUR Date: 2026.08.03 12:17:27 +0530 2 Division Bench Hon’ble Shri Justice Parth Prateem Sahu Hon’ble Shri Justice Sachin Singh Rajput Order on Board Per Parth Prateem Sahu, Judge 29/07/2026 1. Petitioner has filed the present petition challenging the order dated 21.04.2026 passed by Central Administrative Tribunal in Original Application No. 200/406/2026 whereby the original application filed by the applicant/petitioner herein was dismissed. 2. Learned counsel for the petitioner submits that the petitioner is wife of Hardeep Singh who is an employee of railway department. Alongwith other reliefs, she has also sought a relief, to consider and take decision on the representation dated 04.02.20226 and 09.09.2024 and further direction to respondent authorities to inculcate family details in the service sheet. However, Tribunal only considered that the claim of the petitioner is with regard to the maintenance allowance to the applicant and dismissed the original application stating that the application is not maintainable. Learned CAT escaped consideration of the main grievance of the petitioner that petitioner being wife of a railway employee, her name is not entered in the service records of the employee/her husband. 3. Counsel for the respondent supports the award passed by the 3 learned CAT. 4. We have heard learned counsel for the parties and perused the records. 5. Perusal of the reliefs sought for in the Original Application would show that the petitioner had sought multiple reliefs which are quoted below for ready reference: 8.1 To issue an appropriate order directing the respondent to call the entire record relating to the applicant. 8.2 To direct the respondent authorities to decide the representation dated 04.02.2026 and 09.09.2024 [Annexure A/1]. 8.3 To direct the respondent authorities to inculcate family details in the service sheet. 8.4 To direct the respondent authorities to comply with the railway establishment rule 62/2005 and 121/2005 as the applicant and her minor son is being neglected by the railway employee Hardeep Singh working in office of SDPO Railway Bilaspur office superintendent bearing PF No. 39211ABB0584 and currently posted in the office of Jammu (Sr. DPO). 8.5 Kindly pass such other order or relief as deemed fit and proper in the facts and circumstances of the case in favor of the applicant and against the respondent. 6. In relief 8.2, the petitioner is praying to consider and take decision on the representation which the petitioner submitted on 04.02.2026 and 09.09.2024 and further the direction to the respondent authorities to inculcate family details in the service record. 7. Learned tribunal as escaped consideration of the reliefs as claimed in para 8.2. Further, perusal of the cause title of the 4 Original Application would show that the petitioner though is claiming some relief in the service record of one Hardeep Singh stating him to be her husband, however, Hardeep Singh has not been arrayed as a party/respondent/non-applicant. The error can be corrected and rectified in the original proceedings itself. 8. For the foregoing discussion, we find that the order passed by the learned CAT in Original Application overlooking the other reliefs, is not sustainable. Accordingly, the order dated 21.04.2026 passed by Central Administrative Tribunal, Jabalpur Bench, Jabalpur in Original Application No. 200/406/2026 is hereby set-aside and the original application is remitted back to the learned CAT for further consideration. If the petitioner wants to implead her husband/Hardeep Singh, an employee of railway department, she will be at liberty to do so by way of filing appropriate application.
