In Re: An application for bail under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 filed in connection with Bhagwanpur Police Station Case No.87 of 2026 dated 17.02.2026 under Sections 85/103(1)/3(5) of the Bharatiya Nyaya Sanhita, 2023 and Section 3/ 4 of Dowry Prohibition Act, 1961;
Saikat Mondal Versus The State of West Bengal
Mr. Soubhik Mitter Mr. Karan Bapuli. ...for the petitioner.
Mr. Goutam Dey Mr. Arindam Banerjee. …for the State.
Learned advocate appearing for the petitioner submits that the petitioner is the husband who has been implicated in the present case and is in custody for 5 months.
Learned advocate for the State opposes the prayer for bail as according to the prosecution case, there were demands of dowry along with mental and physical torture being inflicted upon the deceased which compelled the deceased to terminate her life.
I have taken into account the postmortem report and its findings. Having considered the same and that the prosecution has relied upon 17 witnesses in order to prove its case which would take some time, I am inclined to release the petitioner on bail. As such, the prayer for bail of the petitioner is allowed.
