JUSTICE P SREE SUDHA ORAL ORDER This writ petition is filed by wife against the order of the Family Court in IA Nos.2 and 3 in G & WC No.158/2024 dated 07.11.2025. 2. Heard both sides. 3. G & WC No.158/2024 is filed by father of the child for permanent custody of the child and during the pendency of the same, IA No.1 is filed by father to direct the mother to give custody of the minor son on every Saturday and Sunday and IA No.2 is filed to permit him to conduct video calls with his son every day for 2 hours. The Family Court considering the arguments of both sides - 3 - HC-KAR NC: 2026:KHC:35514 WP No. 39651 of 2025 granted visitation rights to the father on every first and third Saturday from 12.00 p.m. to 02.00 p.m. in the visitation room of Nyayadegula, Bangalore and also permitted to talk with the child every day for 10 to 15 minutes between 07.00 p.m. to 07.30 p.m. 4. Against the said order, the petitioner/mother preferred this petition. 5. Learned counsel for the petitioner/mother submitted that the visitation rights and audio calls granted results in severe emotional distress to the minor child, as he is crying continuously after visitation sessions and thus requested for quashing the order dated 07.11.2025. But at the time of arguments, learned counsel stated that she has to travel all the way from Kengeri as she is residing there and the distance between her residence and visitation room is around 20 kms and she stated that it is inconvenient for her to travel all the way and has requested for travel expenses. Hence, prays to quash the impugned order. - 4 - HC-KAR NC: 2026:KHC:35514 WP No. 39651 of 2025 6. This Court observed that the said fact is not stated before the Family Court at the time of granting visitation rights and even she has not requested for travelling expenses in this petition. She has prayed only to quash the impugned order. Hence, this Court finds that there is no error apparent on the face of order of the Family Court. So visitation rights are granted to the father only for 2 hours in the Visitation Room, Nyayadegula at Bengaluru in the presence of mother as the child is aged 5 years now and the father is also permitted to talk with the child through video or audio calls everyday only for 15 minutes. This Court finds no infirmity in the order of the Family Court therefore, this writ petition is dismissed confirming the order of the Family Court.
