Learned advocate appearing for the petitioner submits that the petitioner is in custody for 85 days, charge-sheet has already been submitted, as such, the petitioner may be released on bail. Learned advocate for the de facto complainant submits that the petitioner is having a criminal antecedent and while on bail in the other case he has committed the present offence. Learned advocate for the State produces the case diary, opposes the prayer for bail and refers to the injuries which have been inflicted. 2 Records also reflect that two of the accused persons are absconding. Having considered the fact that the petitioner is having a criminal antecedent and while on bail he has committed the offence, at this stage, I am not inclined to release the petitioner on bail. Petitioner would renew his prayer for bail after the case is committed to the court of sessions. Accordingly, learned Magistrate would split up the trial after exhausting the process of law and adhere to the provisions so that the case is committed within the prescribed period as provided under the BNSS. With the aforesaid observations, CRM(M)1547 of 2026 is dismissed at this stage. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
