JUSTICE S VISHWAJITH SHETTY ORAL ORDER Accused no. 2 in S.C.No.5071/2022 pending before the Court of III Additional District and Session Judge, Bangalore Rural District, sitting at Anekal, arising out of Crime No.150/2014 registered by Jigani police station for offences punishable under Sections 302, 201, 114 read with 34 of the IPC is before this Court in this petition filed under Section 483 of Bharatiya Nagark Suraksha Sanhita, 2023, seeking regular bail. 2. Heard learned counsel appearing for the parties. 3. Perusal of the material on record would go to show that on the merits of the case, the petitioner, who was arrested in the present case, was granted regular bail by this Court in - 3 - HC-KAR CNR: KAHC010399122026 NC: 2026:KHC:37732 CRL.P No. 8380 of 2026 Crl.P.No.4607/2016, vide order dated 21.10.2026. It appears that before the Trial Court, the petitioner had not appeared on several dates of hearing and therefore, his presence was secured on 16.04.2026 and on the said day, he was remanded to judicial custody. His bail application filed before the Trial Court thereafter in S.C.No.5071/2022 was rejected on 15.05.2026. Therefore, he is before this Court. 4. Perusal of the material on record would go to show that after the charge-sheet was filed in the present case, the case was committed to the jurisdictional Sessions Court and numbered as S.C.No.5028/2015. Subsequently, the petitioner was granted regular bail by this Court in Crl.P.No.4607/2016. Before the Trial Court, the petitioner had appeared for a considerable period of time and in the year 2022, a split-up case was registered against him in S.C.No.5071/2022 for the reason that he had not appeared before the Trial Court on the regular dates of hearing. In the said case, he has now been arrested on 16.04.2026 and remanded to judicial custody. - 4 - HC-KAR CNR: KAHC010399122026 NC: 2026:KHC:37732 CRL.P No. 8380 of 2026 5. Be that as it may, the fact remains that on the merits of the case, the petitioner was earlier granted bail by this Court and only for the reason that he had not appeared before the Trial Court on the regular dates of hearing, he has now been remanded to judicial custody. For the mistake committed by the petitioner, he has been sufficiently punished. It is not in dispute that he has no other criminal antecedents and he has undertaken to cooperate before the Trial Court for speedy disposal of the case. Under the circumstances, I pass the following: ORDER (i) The criminal petition is allowed. (ii) The petitioner/accused No.2 is ordered to be enlarged on bail in Crime No.150/2014 registered by the Jigani police station for offences punishable under Sections 302, 201, 114 read with 34 of the IPC, subject to the following conditions: a) The petitioner shall execute personal bond for a sum of Rs.1,00,000/- (Rupees One Lakh only) with two sureties for the likesum, to the satisfaction of the jurisdictional Court; - 5 - HC-KAR CNR: KAHC010399122026 NC: 2026:KHC:37732 CRL.P No. 8380 of 2026 b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future; e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is disposed of.
