Learned counsel for the petitioner submits that pursuant to a work order issued in favour of the petitioner on June 22, 2021 for repairing and renovation of 32 units of SSK and MSK toilets at 19 numbers of SSK and MSKs out of Fifteenth Finance Commission Tied Fund maintained by the Purba Bardhaman Zilla Parishad, the petitioner completed the work within due time and raised bills to the tune of Rs.4,24,811/- before the authority. The bills along with measurement books were submitted by the Executive Officer, Jamalpur Panchayat Samity before the Additional Executive Officer, Purba Bardhaman Zilla Parishad on May 24, 2024 for making necessary payment. The said payment is still due. Several representations
submitted by the petitioner in this regard have not been considered. The petitioner seeks clearance of the dues. In view of the fact that the work has been completed by the petitioner successfully and satisfactorily and his payment has been recommended by the Executive Officer, Jamalpur Panchayat Samity, the Secretary, Purba Bardhaman Zilla Parishad, being the 4th respondent herein, is directed to clear the entire dues of the petitioner within eight weeks from the date of communication of this
order subject to the petitioner fulfilling the requisite formalities. The writ petition is disposed of. There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the writ petition are deemed not to have been admitted.
