THIS PETITION, COMING ON FOR PRELIMINARY HEARING, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: - 3 - HC-KAR CNR: KAHC010478492026 NC: 2026:KHC:37109 WP No. 21413 of 2026 CORAM: HON'BLE MR. JUSTICE E.S.INDIRESH ORAL ORDER Learned AGA accepts notice for respondent Nos.1 to 4. 2. In this petition, the petitioner is assailing the order dated 17.04.2026 in R.P.No.148/2024 (Annexure-F) passed by respondent No.2, inter alia, sought for direction to respondent Nos.3 to 5 to continue the revenue entries in MR No.152-3/1993-94. 3. Learned counsel appearing for the petitioner submitted that the name of the petitioner finds place in the revenue records since 1992-93 and therefore, the same has been erroneously interfered with by the respondent - Authorities and accordingly, sought for interference of this Court. 4. Learned Additional Government Advocate sought to justify the impugned order passed by respondent No.2 and submitted that the rival claimant is - 4 - HC-KAR CNR: KAHC010478492026 NC: 2026:KHC:37109 WP No. 21413 of 2026 respondent No.6, who is also claiming rights over the subject property based on the alleged grant order passed in LNDS No.505/1993. Learned AGA, further submits that the rival claims require consideration in the light of the suit pending before the competent Civil Court in O.S.No.56/2004. Accordingly, sought for dismissal of the petition. 5. In the light of the submission made by the learned counsel appearing for the parties and on careful consideration of the mutation entries in MR No.152/1993-94, it is not forthcoming as to how the petitioner's name was entered in the mutation records in respect of the subject land. In that view of the matter, I am of the view that, it is open for the petitioner to establish his right over the property in question in the manner known to law before the competent Civil Court. It is also pertinent to note that respondent No.6 herein has instituted a suit in O.S.No.56/2004, which is pending consideration before the competent Civil Court. In that - 5 - HC-KAR CNR: KAHC010478492026 NC: 2026:KHC:37109 WP No. 21413 of 2026 view of the matter, I am of the view that no interference is called for in this petition. Accordingly, the writ petition is dismissed. It is needless to mention that the petitioner herein is required to prove his title over the property in question in a manner known to law. The revenue entries made by the respondent - Authorities are subject to the petitioner's right to establish his title before the competent Civil Court.
