The Applicant has preferred this anticipatory bail application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of Anticipatory Bail, apprehending his arrest in connection with Crime No.0067/2025, registered at SISTLA NEELIMA VISHNU PRIYA Digitally signed by SISTLA NEELIMA VISHNU PRIYA Date: 2026.08.01 12:01:17 +0530 2 Police Station – Tumla, District Jashpur (C.G.) for alleged commission of offence punishable under Sections 105, 238 and 3(5) of BNS and also under Section 138 of Electricity Act, 2003. 2. As per the prosecution story, a missing person report lodged by the wife of the deceased Yashoda Kujur and it was stated that on 12.12.2025 at about 6:00 p.m., her husband, William Kujur, had left the house stating that he was going for hunting along with four to five persons but did not return home, while the others came back. During investigation, the memorandum statements of the co-accused namely Aydu Ram, Hemsagar Yadav, Matilal Yadav and Lilandri Yadav were recorded, wherein it was disclosed that they, along with the present Applicant, had illegally drawn an 11 KV live electric wire across the agricultural field of Sukhram Chauhan to trap wild animals. It is alleged that the deceased came into contact with the live wire, suffered an electric shock and died. The electric wire and other incriminating articles were seized and the post-mortem report opined that the cause of death was cardio-respiratory failure due to electric shock and that the death was accidental in nature. On the basis of the said complaint, offences mentioned above, were registered against the Applicant. Hence, this application. 3 3. Learned Counsel for the Applicant submits that the Applicant is innocent and has been falsely implicated in the present case. It is further submitted that co-accused Hem Sagar, Lilandri Yadav, Matilal @ Motilal Yadav and Aidu Lohar have already been granted regular bail by this Court vide order dated 20.07.2026 passed in MCRC No.4209/2026. It is contended that the case of the present Applicant stands on the same footing as that of the aforesaid co-accused and the trial is likely to take considerable time for its conclusion, therefore, he is entitled to the benefit of anticipatory bail on the ground of parity. 4. On the other hand, learned State Counsel opposes the application and submits that the co-accused were granted regular bail after their arrest, whereas the present Applicant is seeking anticipatory bail, therefore, the principle of parity is not attracted. It is further submitted that two persons died due to electrocution in the incident and considering the gravity of the allegations, the Applicant is not entitled to the grant of anticipatory bail. 5. I have heard learned counsel for the parties and perused the material available on record. 4 6. Considering the submissions advanced by learned Counsel for the parties, the case diary material, the nature and gravity of the allegations, particularly that two persons lost their lives due to electrocution and further considering that the co- accused have been granted regular bail after their arrest, whereas the present Applicant is seeking anticipatory bail. In the facts and circumstances of the case, this Court does not find it to be a fit case for extending the benefit of anticipatory bail to the Applicant on the ground of parity. 7. Accordingly, the Anticipatory Bail application of the Applicant – Padamlochan Yadav, filed under Section 482 of the BNSS, 2023 in connection with Crime No.0067/2025, registered at Police Station – Tumla, District Jashpur (C.G.) for alleged commission of offence punishable under Sections 105, 238 and 3(5) of BNS and also under Section 138 of Electricity Act, 2003, is hereby rejected. 8.
