Issue an appropriate writ, order or direction declaring the Chhattisgarh Cooperative Societies (Amendment) Act, 2022, insofar as it omits the words "and the State Cooperative Election Commission shall hold elections within six months or twelve months in case of Cooperative Banks" from Section 49(8) of the Chhattisgarh Cooperative Societies Act, 1960, as unconstitutional, arbitrary and ultra vires the Constitution of India. 10.2. Issue an appropriate writ, order or direction directing the Respondent to take steps to conduct elections to the Primary Cooperative Societies, District Cooperative Central Banks and other cooperative societies in accordance with the provisions of the Chhattisgarh Cooperative Societies Act, 1960 within a time period as may be fixed by this Hon'ble Court. 10.3. Pass any other writ, order or direction which this Hon'ble Court may deem fit and proper in the facts and circumstances of the case.” 3. Learned counsel for the petitioner seeks to withdraw this present petition with liberty to file afresh with a proper prayer and pleadings. 4. In view of the same, this petition is dismissed as withdrawn, with liberty to file afresh with appropriate prayer and pleadings. 5. Certified copy of the documents annexed in the petition, if any, may be returned back to the counsel for the petitioner after obtaining the photocopy of the same.
