Kausik (Allowed) CRM (M) 1488 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Nandakumar Police Station Case No. 548 of 2025 dated 29.12.2025 under Sections 85/80 of BNS and Section 4 of Dowry Prohibition Act. And In the matter of : Sistidhar @ Sristidhar @ Sistridhar Barman ……Petitioner. Mr. Amal Krishna Samanta ……for the Petitioner. Mr. Pinaki Bhattacharyya, Sr. Govt. Adv. ……for the State. Learned advocate appearing for the petitioner submits that petitioner is the husband who has been falsely implicated in connection with the instant case and is in custody for more than 200 days. There were matrimonial disputes. Pursuant to which his wife committed suicide and he has been implicated in the present case. Learned advocate for the State opposes the prayer for bail and submits that there was demand of dowry, mental and physical torture. Pursuant to which the lady/victim was forced to terminate her life. I have taken into account the overall circumstances of the case including the time which will be consumed for the trial to be taken to its logical conclusion. Having regard to the 2 overall circumstances as charge sheet has been submitted, I am inclined to release the petitioner on bail. Accordingly, Petitioner, namely, Sistidhar @ Sristidhar @ Sistridhar Barman shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each, one of whom must be local to the satisfaction of Learned CJM, Tamluk. If on bail, the petitioner shall be physically present on each and every date fixed before the learned Trial Court and shall not leave the jurisdiction of District of Purba Medinipur without the prior permission of the learned Trial Court. Accordingly, CRM (M) 1488 of 2026 is allowed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
