Heard Ms.Akansha Jain, learned counsel for the petitioners as well as Mr.Priyank Rathi, learned counsel appearing for respondent No.1. 2. The present petition has been filed by the petitioners under Section 528 of the Bhartiya Nagrik Suraksha Sanhita, 2023 with the following prayers :- “It is, therefore, prayed that this Hon'ble Court may kindly be pleased to allow the petition, may kindly be pleased to quash the FIR No. 0324/2023, Charge sheet and criminal proceedings in criminal case number 27256/2025 arising out of the F.I.R against the petitioners, on the basis of settlement between the parties and further may kindly be pleased to acquit the petitioners from the aforementioned offences, in the interest of justice.” 3. From a perusal of the records, it transpires that Deepak Kundnani, who is also an aggrieved person, has not been made a party respondent, as the compromise has taken place between the 3 petitioners and respondent No. 2. However, the trial Court has summoned Deepak Kundnani, another aggrieved person, and the matter is pending for disposal of the present case on the basis of the compromise entered into between the petitioners and Deepak Kundnani. 4. Learned counsel for the petitioners submits that Deepak Kundnani has further raised a demand of Rs. 4,00,000/-, which is yet to be paid to him. It is also submitted that Deepak Kundnani has not been made a party respondent in the present matter and that the prayer sought is also defective and as such, she prayed for withdrawal of the present petition with liberty to file a fresh petition with appropriate prayer and to implead the necessary party. 5. As prayed, the instant petition is dismissed with liberty to file a fresh petition with an appropriate prayer and to implead the necessary party, subject to depositing a sum of Rs. 2,000/- as costs by the petitioners in the Registry of this Court. The said amount shall be transmitted to the Government Special School for Visually Handicapped Boys and Girls, Jashpur (CG). 6. Certified copy of the documents annexed with this petition shall be returned to counsel for the petitioners after retaining the photocopies of the same.
