This application has been filed under section 483 of the Bharatiya Page No.# 2/3 Nagarik Suraskha Sanhita, 2023, whereby the accused petitioner namely, Soleman Ali, has prayed for bail in connection with Jalukdar P.S. Case No. 94/2026 under Section 112(2)/303(2)/317/61 of BNS, 2023. 3. The case arose out of an FIR dated 19.03.2026 about missing of 19 out of 30 cows kept in Northeast Frontier Goshala Samittee under the jurisdiction of Jalukbari police station. However, during further investigation, it was found that the owner/custodian of the Goshala, Yakub Ali, in collusion with Soleman Ali and Jakir Ali had illegally sold those cows. 4. The learned counsel for the petitioner submits that the petitioner Soleman Ali had legitimately purchased the cows from Yakub Ali. It is submitted that he shall cooperate with the investigation and abide by any conditions imposed. 5. The case diary has been received. 6. It is submitted by the learned Additional Public Prosecutor that the cows which were purportedly owned by one Hasen Ali were seized in connection with Jalukbari P.S. Case No. 91/2026 and which were given in zimma by the learned Additional CJM, Kamrup(M) and when the zimma order was sought to be implemented, the investigating authority ran into the alleged offences of this case. It is stated by the prosecution that investigation has revealed that the custodian of the Goshala, namely, Yakub Ali in collusion with the present petitioner and the other accused have conspired to illegally sell the 19 cows which were kept in the Goshala, pursuant to the order passed by the criminal court. 7. The case diary has been placed before this Court. The IO has also Page No.# 3/3 submitted a bail objection, objecting to the grant of bail. 8. I have perused the contentions of the IO in the said bail objection. The materials in the case diary lend support to the prosecution's contention about incriminating materials against the petitioner. It is also stated in the bail objection that one of the suspected person is still at large and efforts are on to procure his presence for the purpose of investigation. 9.
