D/L285 24.07.2026 Bpg. C.R.M. (M) 1511 of 2026 In Re: An application for bail under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 filed in connection with Chanchal Police Station Case No.775 of 2025 dated 17.06.2025 under Sections 329(3)/117(2)/118(2)/303(2)/351(2)/3(5) of the Bharatiya Nyaya Sanhita, 2023 adding Section 103(1) of the Bharatiya Nyaya Sanhita, 2023; Ashadullah Versus The State of West Bengal Ms. Sujata Das. ...for the petitioner. Mr. Pinaki Bhattacharyya. …for the State. Learned advocate appearing for the petitioner submits that the petitioner is in custody for 7 months and petitioner is innocent and has been falsely implicated in connection with the instant case. Learned advocate for the State opposes the prayer for bail and submits that there is a history in respect of the present case regarding abduction of the daughter of the complainant. Be that as it may, I find that the case is of June, 2025 and till date the case has not been committed to the court of sessions. Having considered the same, I direct the learned Magistrate to take steps for committal of the case to the court of sessions. Petitioner would approach this Court after the stage of consideration of charges are over. The whole of the process be 2 concluded within a period of five months from the date of communication of this order. With the aforesaid observations, CRM(M)1511 of 2026 is dismissed. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities. (Tirthankar Ghosh, J.)
