JUSTICE M.NAGAPRASANNA ORAL ORDER Heard Sri Shrikanth Badaradinni, learned counsel appearing for the petitioner, Smt Deepthi Alva, learned High Court Government Pleader appearing for respondent No.1, Sri H E Ramesh, learned counsel appearing for respondent No.2 and have perused the material on record. 2. During the pendency of the proceedings, the parties to the lis have settled the dispute among themselves and have - 3 - HC-KAR CNR: KAHC010213962026 NC: 2026:KHC:37667 CRL.P No. 4703 of 2026 filed a memorandum of compromise petition under Section 528 of BNSS, 2023. The memorandum of compromise petition reads as follows: " MEMORANDUM OF COMPROMISE PETITION " "The Petitioner and the Respondent No.2 submit as follows: 1. It is submitted that the present Crl. Petition is filed by the Petitioner /accused No.1 challenging the Charge sheet filed in CC NO. 419/2023 against the Petitioner herein for the offences punishable u/s. 498-A, 504,506,149 and section 4 of DP Act by the Mysore City, Women Police Station pending on the file of the VII Addl. Civil Judge [Jr.Dn] JMFC court JLB Road, Mysore, arraigning the Petitioner and others as accused NO. 1 to 7. 2. The Petitioner and Respondent No.2 are being husband and wife and accused NO. 2 to 7 are the relatives of the petitioner/accused No.1. Wherein, due to some matrimonial differences/misunderstandings between the petitioner and respondent No.2, which led to the lodging of the Complaint and the subsequent to the registration of FIR in Crime No.0115/2023, the charge sheet has been filed in C.C. NO. 419/2023, by the Mysore City Women Police Station. Thereafter, with the intervention and considered advice of elders and well-wishers of both families, the parties have amicably resolved all their differences and have mutually agreed to settle the matter in its entirety. 3. Accordingly, the Respondent No.2 submits that she has no objection to quash the proceedings in CC. No. 419/2023 [arising out of crime NO.0115/2023, registered against the petitioner and others, pending on - 4 - HC-KAR CNR: KAHC010213962026 NC: 2026:KHC:37667 CRL.P No. 4703 of 2026 the file of the VII Addl. Civil Judge [Jr.Dn] JMFC court JLB Road, Mysore. 4. It is submitted that, in terms of the settlement arrived between the parties, the respondent No.2 has agreed to withdraw the proceedings pending in C.C NO. 419/2023 [arised out of Crime No.0115/2023] against the Petitioner and others for the offences punishable u/s. 498-A, 504, 506, 149 and section 4 of Dowry Prohibition Act by the Mysore City, Women Police Station pending on the file of the VII Addl. Civil Judge [Jr.Dn] JMFC court JLB Road, Mysore, arraigning the Petitioner and his relatives as accused NO.1 to 7. As such the Respondent No.2 has no objection to allow the present petition and quash the proceedings in CC. NO.419/2023, against the Petitioner and others for the offences u/s. 498-A, 504, 506, 149 and section 4 of Dowry Prohibition Act by the Mysore City Women Police Station pending on the file of the VII Addl. Civil Judge [Jr.Dn] JMFC court JLB Road, Mysore, arraigning the accused NO.1 to 7. 5. The Petitioner and Respondent No.2 agreed that, they will not initiate any further legal proceedings, whether civil or criminal, against each other before any Court or Authority for the same cause of action and either of the party will make any future claims, maintenance/property or seek any arrears from either side. 6. Both the parties hereby declare that they shall have no claim of any nature whatsoever against each either present, past or future. 7. Both the parties herein further state that there has been no collusion or force, fraud or any undue influence in entering into the settlement or agreement in the aforesaid manner. The parties agreed that, the present compromise petition is a reflection of their understanding and the terms of the same are finalized - 5 - HC-KAR CNR: KAHC010213962026 NC: 2026:KHC:37667 CRL.P No. 4703 of 2026 after due deliberations, amicably and upon mutual consent. Hence, the terms of the present petition are binding on the parties and shall not be challenged by them. WHEREFORE, it is prayed that, this Hon'ble Court be pleased to allow the petition as prayed for and quash the proceedings in CC No.419/2023 (arised out of the Crime No.0115/2023, dated:03/07/2023) against the petitioner and others for the offences u/s. 498-A, 504, 506, 149 and section 4 of Dowry Prohibition Act by the Mysore city, Women Police Station pending on the file of the VII Addl. Civil Judge (Jr.Dn.) JMFC Court, JLB Road, Mysore, arraigning the petitioner/Accused No.1." 3. In the light of the settlement arrived at between the parties, I deem it appropriate to accept the memorandum of compromise petition and close the proceedings against the petitioner in the subject petition. 4. The crime so registered against the petitioner as well as the charge sheet so filed pursuant to the crime in CC No.419 of 2023 stands quashed. 5.
