Mr. Sumit Ray, Mr. Santanu Talukdar, Mr. Sailen Naskar …for the petitioner In this application, the petitioner is aggrieved with the inordinate delay caused in disposal of the proceeding being A.C.1743 of 2022 presently pending before learned Judicial Magistrate, 9th Court, Alipore under Section 138 of the N.I.Act. Learned Counsel appearing on behalf of the petitioner submits that the complaint was lodged against the opposite party herein on 19.06.2022 and the Trial Court after examining the complainant under Section 200 of the Cr.P.C. issued process against the accused/opposite party herein on 14.12.2022. Since then the accused no.2 is absconding and the criminal case has not proceeded any further. Having heard learned Counsel for the petitioner it appears that the prayer made by the petitioner is innocuous and, as such, the service of copy of application upon the opposite party is dispensed with. Having considered submission made on behalf of the petitioner and also considering the fact that the present proceeding initiated under Section 138 of the N.I.Act has got stalled since 2 December, 2022, i.e. for about 3 and ½ years, I find that the prayer made by the petitioner for expeditious disposal of the said proceeding is justified and required to be allowed to secure the ends of justice. In view of above, CRR 1162 of 2026 is hereby disposed of with a direction upon the Court below for expeditious disposal of the proceeding being A.C. No.1743 of 2022, presently pending before learned Judicial Magistrate, 9th Court, Alipore and in the event of wilful absconsion of the accused/opposite party, the Court below will proceed further in accordance with Sections 84/85 of the BNSS in order to secure the attendance of the opposite party/accused.
