Kausik (Allowed) CRM (A) 2125 of 2026 In Re: An Application for Anticipatory Bail under Section 438 of the Code of Criminal Procedure, 1973/Under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Nandakumar Police Station Case No. 410 of 2025 dated September 19, 2025 under Sections 126(2)/127(2)/87/69/351(2)/3(5) of the BNS, 2023 read with Section 6 of the POCSO Act. And In the matter of : Sulekha Dinda @ Sulekha Dinda Samanta ……Petitioner. Mr. Navanil De Mr. Subhrajit Dey ……for the Petitioner. Mr. Jayed Hossain Ms. Afreen Begum Mr. Dip Dutta …..for the Victim. Ms. Soma Mishra Chatterjee Ms. Casurina Chatterjee ……for the State. Learned advocate appearing for the petitioner submits that petitioner has been implicated as she is the mother of the principal accused. There are accusations against her but she being innocent and charge sheet having been submitted, her custodial detention may not be warranted. Learned advocate for the State produces the case diary, draws the attention of the Court to the statement of the victim under Section 183 of the BNSS. The principal offender is a 2 CCL. Petitioner’s implication in the charge sheet so far as the offences under POCSO Act is concerned, is under Section 17 of the POCSO Act. Having considered the same and the fact that charge sheet has already been submitted, I am inclined to allow the prayer advanced before this Court. As such, I direct that in the event of arrest, the petitioner namely, Sulekha Dinda @ Sulekha Dinda Samanta, be released on bail subject to the satisfaction of the investigating officer/arresting officer of the case and also subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and/or under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. Since charge sheet has already been submitted, this order of anticipatory bail will remain in force for a period of 6 weeks. Accordingly, CRM (A) 2125 of 2026 is allowed. Memo of Evidence submitted be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
