1. Learned State counsel submits that the dispute raised in the present petition can be considered in view of the subsequent amendment, whereby the issue with regard to the Mahar caste has been clarified/resolved by the subsequent amendment/circular dated 04.09.2023 issued by the State Government. It is submitted that the social status certificate of the petitioner was denied only on the ground that the name of the petitioner’s caste does not find place in the Scheduled Tribe list.
2. In view of the aforesaid submission, the petitioner is relegated to avail the remedy of submitting an appropriate application along with the circular dated 04.09.2023 issued by the State Government before the competent authority. Upon such application being filed, respondent No. 2 shall consider and decide the same in accordance with law, by passing a reasoned and speaking order.
3. With the aforesaid direction/observation, the writ petition stands
disposed of.
4. It is made clear that this Court has not expressed any opinion on the merits of the case and the competent authority shall be at liberty to consider and decide the matter independently in accordance with law. sd/- (Amitendra Kishore Prasad) Judge Vishakha
