D/L272 27.07.2026 Bpg. C.R.M. (M) 1531 of 2026 In Re: An application for bail under section 439 of the Code of Criminal Procedure corresponding to Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 filed in connection with Rejinagar Police Station Case No.175 of 2023 dated July 08, 2023 under Section 302 of the Indian Penal Code read with Section 4 of the Explosive Substances Act and charge-sheet submitted under Sections 302/120B of the Indian Penal Code; Selim Sk. @ Selim Sekh Versus The State of West Bengal Mr. Navanil De Ms. Monami Mukherjee. ...for the petitioner. Mr. Gouranga Kr. Das Mr. Amartya Mohan Bhattacharyya. …for the State. Mr. Samim Ahammed Ms. Gulsanwara Pervin Mr. Arka Ranjan Bhattacharya. …for the de facto complainant. Learned advocate appearing for the petitioner submits that the petitioner is similarly situated as the other accused person who has been granted bail. Petitioner is in custody for 3 years and there is no possibility of the trial having been concluded. Learned advocate for the State submits that 16 witnesses have been examined and the prosecution would put in efforts to place few more witnesses in support of its case. Learned advocate for the de facto complainant opposes 2 the prayer for bail. Having considered the complicity of this petitioner, I am of the opinion that he is not similarly situated as the other accused person, as according to the prosecution case, bomb was hurled by this petitioner. As such, the prayer for bail of the petitioner in CRM(M)1531 of 2026 is dismissed. Learned trial court would, as submitted by the prosecution, within a period of six months complete whole of the proceedings and proceed towards pronouncing the verdict. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities. (Tirthankar Ghosh, J.)
