Enquiry report submitted in compliance to order dated 27th April, 2026 by District Inspector of Schools (PE) North 24 Parganas is taken on record. 2. By the present writ petition, the petitioner seeks direction upon the respondent authorities to conduct the verification process of the petitioner in respect of recruitment process of 2009 initiated by District Primary School Council (in short ‘DPSC’), North 24 Parganas. 3. The petitioner contends that he participated in the recruitment process of 2009 conducted by the Council. Since the petitioner was not granted appointment, the petitioner filed a writ petition being WPA 6569 of 2021 which was disposed of by order dated 9th May, 2024. The order reads as follows: “2. The petitioners’ claim is therefore covered by the order dated 25.04.2024 passed in WPA 20966 of 2022 (Kakali Mondal &. Others vs. The State of West Bengal and others). 3. The petitioners shall get the benefit of the said order on the same terms and conditions mentioned therein.” 4. It appears from the aforesaid order that the petitioner was granted the benefit of order dated 25th April, 2024 passed in WPA 20966 of 2022 (Kakali Mondal & Ors. v. The State of West Bengal & Ors.). Pursuant thereto, the District Primary School Council issued a notification on 29th April, 2024 for verification of documents. The last date of which was fixed on 13th May, 2024. 5. The petitioner contends that from 28th April, 2024 till 5th May, 2024 the petitioner was hospitalised for treatment of appendicitis. For such reason the petitioner could not appear before the Council for verification of documents. 6. In order to assess the veracity of the said contention District Inspector of Schools (PE) North 24 Parganas was directed to cause enquiry and submit enquiry report. The discharge summary of the Nursing Home annexed to the supplementary affidavit shows that the petitioner was admitted to the New City Nursing Home for his treatment. Although the enquiry report reveals that the petitioner was admitted from 28th April, 2024 till 5th May, 2024 in the said Nursing Home, however, the same shows that no document of admission register and cash receipt register found to be maintained by the Nursing Home. Be that as it may, the enquiring officer has recorded the statement of the doctor, namely, Dr. Subhadip Sarkar who treated the 2 petitioner. The statement was video-graphed in a compact disc. The statement video-graphed is played in the open court. Upon considering the statement of the doctor it manifests the petitioner was admitted under the said doctor for his treatment of lumb in appendix for a week. The treatment sheet annexed to the enquiry report shows that the petitioner was administered medicine in the said Nursing Home from 28th April 2024 to 5th May 2024. Thus, it goes without saying that the petitioner was admitted to the said hospital during the above period. 7. In the above conspectus, this court is of the view that the petitioner should be given an opportunity for verification of documents. 8. Accordingly, respondent no.3, District Primary School Council, North 24 Parganas is directed to issue a corrigendum fixing a date for verification of documents of the petitioner and thereafter act in accordance with law in terms of the order passed in WPA 6569 of 2021. 9. Learned advocate for the petitioner is directed to communicate this order to respondent no.3, District Primary School Council, North 24 Parganas, for necessary compliance. 10. With the aforesaid directions, the writ petition being WPA 7067 of 2025 stands disposed of. 11. Since no affidavits have been called for, the allegation made in the writ petition is deemed to be not admitted. 12. Interim order, if any, stands vacated. 13. All connected applications, if any, stand disposed of. 3 14. There shall be no order as to costs. 15. All concerned parties shall act in terms of the copy of the order duly downloaded from the official website of this Court. 16.
