1. By way of this petition, the petitioner has prayed for following reliefs:-
“10.1 That the Hon'ble Court may kindly further be pleased to call for the entire records pertaining to the case of petitioner and thereafter allow this petition. 10.2 That this Hon'ble Court may kindly be pleased to allow the petition directing the respondent No.2 to pay the awarded amount Rs.79,82,224/-to petitioner within stipulated time as per the list (Ann. P-1 & P-2) issued by the authority as on 01/3/2023 showing the name of petitioner in the Village-wise list of undistributed compensation amount with 9% interest per annum from the date of award dated 06/01/2016 till the date of release of payment. 10.3 That, any other reliefs which this Hon'ble High Court deems fit and proper in the facts and circumstances of the case be also granted to the petitioner in the interest of justice.”
2. When the matter was taken up for hearing, none appeared on behalf of the petitioner. The case was thereafter passed over and taken up again in the second round, however, even then, none appeared for the petitioner to prosecute the matter. Accordingly, this Court proceeds to consider the matter on the basis of the
3 material available on record and the submissions advanced on behalf of the respondents. 3. Learned counsel appearing for respondent No. 1 invited the attention of this Court to the reply filed on behalf of the said respondent and submitted that the compensation amount determined in favour of the petitioner has already been duly disbursed.
In this regard, reference has been made to paragraph 15 of the reply (at page No. 10), wherein it has been specifically stated that the compensation payable to the petitioner has been duly processed and released through the Bhoomi Rashi Land Acquisition Portal. The payment details generated from the said portal also indicate that the compensation amount has already been processed and disbursed in accordance with law. 4. In view of the aforesaid facts, it is evident that the grievance raised by the petitioner in the present writ petition has already been duly redressed by the competent authorities. As the relief sought by the petitioner has already been granted and no surviving cause of action remains for adjudication, the present writ petition has become infructuous and is accordingly disposed of.
