(At Present Accused Petitioner Confined In Sub Jail Deeg). 2. Arsida W/o Jakar @ Noor Mohammad, Aged About 23 Years, R/o Nangal, Police Station Kaithwada, District Deeg, Presently Resident Of Dondal, Police Station Punhana, District Nuh Mewat (Haryana) (At Present Accused Petitioner Confined In Sub Jail Deeg). ----Petitioners Versus State Of Rajasthan, Through Pp ----Respondent For Petitioner(s) : Mr. Ankit Khandelwal For Respondent(s) For Complainant : : Mr. Jaiprakash Tiwari, PP Mr. Anoop Kumar HON'BLE MR. JUSTICE PRAMIL KUMAR MATHUR Order 23/04/2026 1. The petitioners have preferred this bail application under Section 483 of BNSS in FIR No.180/2025 registered at Police Station Kaithwara, District Deeg for offences under Sections 189(2), 115(2), 126(2), 351(3), 140(2) and 127(2) of BNS, 2023. 2. Heard learned counsel for the petitioners, learned Public Prosecutor as well as learned counsel for the complainant and perused the material available on record. 3. Learned counsel for the petitioners submits that the petitioners have falsely been implicated in this case. He argued that the allegation made against the petitioners claiming their involvement in the abduction of the victim, Abid, and demanding Rs. Two lakh is not tenable. Learned counsel for the petitioners [2026:RJ-JP:17273] (2 of 2) [CRLMB-16468/2025] point out that the victim’s statement recorded under Section 183 of the BNSS does not mention the name of petitioners, nor does the victim indicate in the statement that any photo in question was clicked by the petitioners. Furthermore, the second petitioner is a 23-year-old woman. The petitioners have been in custody since 02.11.2025 with one criminal antecedent has been reported against the petitioner no.2. Charge-sheet has been filed. The trial of the case will take considerable time, therefore, no fruitful purpose would be served by keeping the petitioners in further custody, consequently, the bail application deserves to be allowed. 4. Learned Public Prosecutor and counsel for the complainant have vehemently opposed the bail application. 5. On consideration of the rival submissions and material available on record and in light of submission made by learned counsel for the petitioners but without expressing any opinion on merits/demerits of the case, I am inclined to grant benefit of bail to the petitioners. 6. Consequently, the bail application under Section 483 B.N.S.S. is allowed and it is directed that the petitioners Shailesh S/o Namdev and Arsida W/o Jakar @ Noor Mohammad, be released on bail provided each of them furnish a personal bond in the sum of Rs.50,000/- with two sureties in the sum of Rs.25,000/- each to the satisfaction of the learned trial court with the stipulation that they shall appear before that Court on all subsequent dates of hearing till conclusion of the trial.
