HC-KAR NC: 2026:KHC:18673 WP No. 17868 of 2024 ORAL ORDER In this petition, petitioner seeks the following relief. i)issue a writ in the nature of certiorari to quash the impugned order bearing No.ED 21 TPU 2019 Bengaluru Dated: 15.3.2024 passed by the 1st respondent vide Annexure-L; ii) issue a writ in the nature of mandamus directing the respondents to extend the time in favour of the petitioner for acquiring M. Ed. Qualification as extended to all other Physical Education Teachers as per Government Order bearing No.ED 360 DGW 2014, Bengaluru dated: 25.2.2019 vide Annexure-H; iii) issue any writ, order or direction as deems fit in the circumstances of the case and allow the above writ petition with costs, in the interest of justice and equity."
2. Heard learned counsel for the petitioner and learned AGA for respondent Nos.1 to 4 and respondent No.5. Perused the material on record.
3. In addition to reiterating the various contentions urged in the petition and referring to the material on record, learned counsel for the petitioner invited my attention to the impugned

order at Annexure - L dated 15.03.2024 in order to contend that the said order was passed without providing sufficient or reasonable opportunity to the petitioner to put forth his contentions and produce documents and as such the impugned order being violative of principles of natural justice, the same deserves to be set aside and the concerned respondents may be directed to reconsider the matter afresh in accordance with law after providing sufficient and reasonable opportunity to the petitioner.
4. Per contra, learned counsel for the respondents submit that there is no merit in the petition and the same is liable to be dismissed.

As rightly contented by the learned counsel for the petitioner, a perusal of the impugned order which perverts and seeks to withdraw the grant in aid conferred in favour of the petitioner has been passed without providing sufficient or reasonable opportunity to the petitioner nor hearing him as required in law, thereby visiting him with serious civil consequences affecting his valuable rights.

Under these circumstances, on the short/simple ground of violation of principles of natural justice, I deem it just and appropriate to set-aside the impugned order at Annexure - L dated 15.03.2024 and remit the matter back to the concerned respondents for reconsideration afresh and in accordance with law.
7. In the result, I pass the following:
ORDER (i) Petition is hereby allowed. (ii) The impugned
order passed by respondent No.1 dated 15.03.2024 at Annexures - L is hereby set aside. (iii) Matter is remitted back to the concerned respondent for reconsideration afresh and in accordance with law after providing sufficient and reasonable opportunity to the petitioner and to proceed further in accordance with law. (iv) Liberty is reserved in favour of the petitioner to submit pleadings, documents etc., before the concerned respondent, who shall provide sufficient and reasonable opportunity to the petitioner
