The grievance of the appellant is directed against an order dated 17th November, 2025. Briefly, the writ petitioner had challenged an order dated 24th April, 2025 passed by the Director, District Distribution Procurement and Supply assessing a penalty of Rs.16,07,145/- on the petitioner. It is pertinent to mention that the petitioner had been initially directed to pay an amount of Rs.24,10,717.35. By the impugned order dated 17th November, 2025, the Learned Trial Court after recording that the amount of Rs.24,10,717.35 had been justifiably reduced to Rs.16,07,145/- directed the appellant to pay three equal instalments commencing from 10 December, 2025. 2 It is submitted on behalf of the appellant that the time to make payment be further extended since the appellant had been unable to make payment within the stipulated time period. We find that there is nothing unlawful, arbitrary or perverse in the exercise of discretion by the Trial Court. On the contrary, the prayer for instalments was at the invitation of the appellant and the appellant cannot now procrastinate payment. It is evident that the entire attempt of the appellant is to unnecessarily and unjustifiably prolong payment. In such circumstances, there are no grounds to interfere with the impugned order. MAT 262 of 2026 along with CAN 1 of 2026 is dismissed. In view of the fact that the entire payment of Rs. 16,07,145/- has not been paid till date, the respondent authorities are at liberty to take all coercive measures in accordance with law to ensure payment of the entire amount of Rs. 16,07,145/-.
