Rakib (Rejected) CRM (M) 1496 of 2026 In Re: An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/Under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Santipur Police Station case no. 05 of 2023 dated 02.01.2023 under Sections 302/34 of the Indian Penal Code, 1860. And In the matter of : Bijoy Barman @ Jaladhar ……Petitioner. Ms. Minoti Gomes .....for the Petitioner. Mr. Gautam Dey Mr. Ranajit Ghosh Mr. Sanjib Das ……for the State. Learned advocate appearing for the petitioner submits that petitioner was arrested on 20th of March, 2026 and since then he is in custody and as he is innocent of the charges he may be released on bail. Learned advocate appearing for the State on the other hand submits that charge-sheet was furnished before the jurisdictional Court in July, 2023, charges have been framed and five witnesses have been examined. Petitioner was absconding for more than three years. Records reflect other accused persons are on bail but as the present petitioner was absconding there is every possibility of charges being freshly framed against the petitioner and the witnesses recalled. At this stage, I am not inclined to release the petitioner on bail. 2 Petitioner will renew his prayer for bail after the evidence of five witnesses already cited are recalled and cross-examined. Consequently, CRM (M) 1496 of 2026 is dismissed at this stage. Liberty is granted to the petitioner to approach this Court after the said stage is over. Memo of evidence submitted by the State be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
