Learned advocate for the State opposes the prayer for bail and draws the attention of the court to the injury report which is available in the case diary. Learned advocate for the defacto-complainant emphasizes that the granary of the defacto-complainant was 2 set on fire and a sum of Rs.1 lakh was extorted, further amount was also demanded, which the complainant having failed to pay was subjected to assault. I have taken into account the factum of injuries and the accusations of the defacto-complainant that the granary was set on fire. However, the case diary do not reflect any seizure and/or any burnt materials being available in the case diary. The petitioner no.1 is 62-year-old and the petitioner no.2 is 59-year-old. Having considered the overall circumstances, I am inclined to grant anticipatory bail to the petitioners. Hence, the prayer for anticipatory bail of the petitioners is Allowed. Accordingly, I direct that in the event of arrest, the petitioners [Uttam Kumar Mondal and Krishna Gopal Mondal @ KrishnaGopal Mondal] be released on bail upon furnishing bond of Rs.20,000/-(Rupees Twenty Thousand only) each, with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local, to the satisfaction of the arresting officer of the case and also subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and/or under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. 3 As the investigation of the case is still in progress, the petitioners shall enter the jurisdiction of Bhatar Police Station only for the purposes of meeting with the Investigating Officer of the case once a week till the charge- sheet is submitted before the learned jurisdictional court. Additionally, the petitioners will not reside within the jurisdiction of Bhatar Police station till the charge-sheet is submitted and/or the conditions imposed are reconsidered by the jurisdictional court in seisin of the case.
