In Re : Kaustav Jagat Roy and others
... Petitioners. Mr. Sabyasachi Banerjee, Sr. Adv., Mr. Abhra Jena, Mr. Abhishek Mukherjee
... For the Petitioners. Mr. Brajesh Jha, APP, Mr. Mukesh Kumar Gupta
... For the State. Mr. Rudraman Bhattacharya, Sr. Adv., Mr. Nigam Ashish Chakraborty, Mr. Agniva Banerjee, Ms. Ankita Paul, Ms. Sweta Kapuria
... For the Opposite Party No.2. Learned senior advocate appearing for the petitioners submits that petitioner no.1 is the husband, petitioner no.2 is the mother-in-law and petitioner no.3 is the sister-in-law of the complainant and they have been foisted in the present criminal case because of matrimonial dispute. Learned advocate appearing for the opposite party no.2 opposes the prayer for anticipatory bail and submits that till date the complainant is under threat. Learned advocate appearing for the State also opposes the prayer for anticipatory bail. I have taken into account the prescribed punishment which is below seven years and the case emanates from a
2 matrimonial dispute. Having considered the same, I am of the opinion that although the petitioners should cooperate with the investigation, but their custodial detention in connection with the instant case is unwarranted. As such, the prayer for anticipatory bail of the petitioners is allowed. Accordingly, in the event of arrest, the petitioners viz.,
1. Kaustav Jagat Roy, 2. Sangita Majumdar and 3. Swapna Roy shall be released on bail to the satisfaction of the Arresting Officer on such terms and conditions as he deems fit and proper subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973 corresponding to Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita,
2023. Since the investigation of the case is still in progress, the petitioner no.1 shall make himself available as and when called for by the Investigating Officer of the case. Memo of Evidence submitted by the learned advocate appearing for the State be kept with the record.
The application for anticipatory bail, being CRM (A) 2153 of 2026, is, thus, disposed of. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
