Mr. Kalyan Bandopadhyay Mr. Rahul Kumar Singh Mr. Md. Danish Farooqui. …for the petitioner.
Mr. Kallol Mondal, Ld.P.P. Mr. Ayan Basu Mr. Gautam Banerjee. …for the State.
Learned senior advocate appearing for the petitioner submits that the petitioner has been politically victimised after there has been change of administration.
Learned advocate for the State opposes the prayer for anticipatory bail on various grounds particularly the manner in which materials have surfaced in course of investigation relating to allotment of permits, filling up water-bodies, illegally occupying the Government land and selling them to other individuals.
So far as the statements of the affected individuals are concerned, there are no specific allegations against the present
2 petitioner, namely, Avijit Das. Accordingly, his prayer for anticipatory bail is allowed.
Accordingly, in the event of arrest, the petitioner, namely, Avijit Das shall be released on bail to the satisfaction of the Arresting Officer and also be subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure corresponding to Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
As the investigation of the case is in progress, petitioner shall within a period of 10 days meet with the investigating officer of the case and subsequently make himself available as and when called for by the investigating officer of the case.
