1. Affidavit-of-service filed on behalf of the petitioner is taken on record.
2. Prayer is made in this writ petition for directing the concerned police authorities to initiate criminal prosecution under certain provisions of BNS 2023.
3. State respondents and respondent no.4 are represented by learned advocates who have jointly opposed this writ petition and it is contended that issue in this writ petitioner is civil in nature.
4. On behalf of the State respondents, a communication dated 20th July, 2026 of Officer-in-Charge, Liluah Police Station is filed and same is taken on record. Copies of said communication are made over to the
2 learned advocates representing petitioner and respondent no.4.
5. It is disclosed in said communication dated 20th July, 2026 at present owner of the land in question is in possession. A suit was instituted by the owner of land, namely, Sk. Moinuddin Ali being Title Suit No.50/2026, which is pending for adjudication.
6. If right of the petitioner in connection with land in question is infringed in that event petitioner needs to approach civil court in pursuit of remedy. Police authority is not the appropriate authority to decide the right of the petitioner over land in question.
7. Hence, present writ petition is not interfered with and same stands dismissed.
8. All parties shall act on the server copies of this order duly downloaded from the official website of this Court.
