Mr. Tanmay Chowdhury Mr. Soutam Kumar Maity Ms. Ritoprita Ghosh ......for the De-facto complainant Learned advocate appearing for the petitioner submits that the genesis of the case is based on matrimonial dispute and both the parties are contesting against each other in respect of many proceedings. Learned advocate appearing for the State opposes the prayer for bail and submits that present petitioner has misused the banking procedures to his advantage and the same is to deprive the de-facto complainant. Learned advocate appearing for the de-facto complainant opposes the prayer for bail and also submits that misrepresentation was made in the proceedings under the Protection of Women From Domestic Violence Act, 2005. To that effect it has been submitted 2 that impression and/or evidence were substantiated before the said Court relating to Punjab National Bank and Bandhan Bank. There is nothing in the Case Diary to suggest that such issue was brought to the notice of the jurisdictional Court which was in seisin of the issue. Having regard to the same and the genesis of the case was disruption of matrimonial relationship, I am of the opinion that so far as the this case is concerned, custodial detention of the present petitioner is unwarranted. As such, prayer for anticipatory bail of the petitioner is allowed. Accordingly, I direct that in the event of arrest, the petitioner namely, Subrata Kumar Sur shall furnish bond subject to the satisfaction of the investigating officer/arresting officer of the case and also subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and/or under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. Since, the investigation of the case is in progress, petitioner shall make himself available as and when called for by the investigating officer of the case. Accordingly, CRM (A) 2135 of 2026 is allowed. Memo of evidence submitted by the State be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. 3 Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
