In this application, the petitioners have prayed for a direction upon the Court below for expeditious disposal of GR Case No. 1649/2022 presently pending before learned Judicial Magistrate, 5th Court, Barrackpore, North 24- Parganas. 2. Being aggrieved by the inordinate delay caused in disposal of the said proceeding, learned Counsel for the petitioners submits that the criminal proceeding was initiated by the de facto complainant/opposite party herein on 25th February,
2022. After completion of investigation, Police submitted charge-sheet on 31st August, 2022. Thereafter, charge was framed and the case was fixed for examination of the prosecution witness no. 1 which has been recorded in part long back but thereafter the proceeding has got stalled for more than three years. He further submits that the
2 prosecution proposes to examine only six witnesses. Therefore, petitioners pray for appropriate direction upon the Court below for expeditious disposal of the said proceeding. 3. Having heard learned Counsel for the petitioners, it appears that the prayer made by the petitioners is innocuous and if it is allowed in terms of the prayer made in the application the opposite party will have no cause to prejudice and as such service of copy of application upon the opposite party is dispensed with. 4. Having heard learned Counsel for the petitioners and also considering the fact that the proceeding has got stalled since 16.11.2024, I find that the prayer made by the petitioners is justified and required to be allowed to secure the ends of justice. 5. In view of above, the instant proceeding being CRR/2779/2026 is hereby disposed of with a direction upon the Court below to make every endeavour for expeditious disposal of the proceeding being GR Case No. 1649/2022 presently pending before learned Judicial Magistrate, 5th Court, Barrackpore, North 24-Parganas and to make his best effort to conclude the entire proceeding within a period of six months from the next date of hearing. 3
