The present intra Court appeal has been filed impugning the judgment and order dated 20.04.2023 passed by the Writ Court in W.P.No.28572/2018, filed by the appellant.
2. The parties are referred to as per their ranking before the Writ Court.
3. While the petitioner was working as Senior Depot Manager at Chikkamagaluru Depot of the Karnataka

State Road Transport Corporation1, he faced a domestic inquiry for the charges that he had not declared the investment made by him amounting to Rs.4,71,900/- for the assessment year 2008-2009, 2009-2010 and 2010-
2011.

Since in the returns filed by him, he did not disclose the investment of Rs.4,71,900/- for the block period 2008-2009, 2009-2010 and 2010-2011, the KSRTC found the said non-disclosure as misconduct as provided under Regulation 14(2) and 14(3) of KSRTC Employees Conduct and Disciplinary Regulations, 19712.
5. The Enquiry Officer found the charge proved against the petitioner for violating Regulation 14(2) and 14(3) of the Regulations, 1971, thereby, the Disciplinary Authority passed the order inflicting punishment of withholding one annual increment with cumulative effect.

The appellant's explanation that said investment was made by his father-in-law and his name was not accepted.
6. We find no reason to interfere with the impugned judgment and order passed by the learned Single judge, wherein the learned Single judge has upheld the penalty imposed on the petitioner for violation of Regulation 14 (2) and 14(3) of the Regulations, 1971. We therefore, dismiss this appeal.
