Petitioner is aged about 82 years and has sought for a direction upon the Court below for expeditious disposal of the proceeding being GR Case No. 6874/2024 presently pending before learned 3rd Court of Judicial Magistrate at Barrackpore. 2. Being aggrieved by the inordinate delay caused in disposal of the said proceeding, learned Counsel for the petitioner submits that the instant case was initiated on 05.10.2024 and the charge-sheet was submitted on 28.12.2024 and since then the Court below has not conducted the charge hearing and fixing dates one after another. Therefore, he prayed for necessary direction upon the Court below for expeditious disposal of the said proceeding. 3. Having heard learned Counsel for the petitioner, it appears that the prayer made by the petitioner is innocuous and if it 2 is allowed in terms of the prayer made in the application the opposite party will have no cause to prejudice and as such service of copy of application upon the opposite party is dispensed with. 4. Having heard learned Counsel for the petitioner and also considering the fact that the proceeding has got stalled for more than one and half years, I find that the prayer made by the petitioner is justified and required to be allowed to secure the ends of justice. 5. In view of above, the instant proceeding being CRR/3045/2026 is hereby disposed of with a direction upon the Court below for expeditious disposal of the proceeding being GR Case No. 6874/2024 and to make his best effort to make the charge hearing on the date fixed, i.e. 2nd September, 2026 or preferably within a period of three months from the next date of hearing. 6.
