And In Re : Musabur Sk @ Musabur Hosen and others ... Petitioners. Mr. Shamim ul Bari, Mr. Raju Mondal, Mr. Masooq Rahman, Ms. Ashmita Mitra ... For the Petitioners. Dr. Pradip Banerjee, APP, Mr. Sunil Gupta ... For the State. Learned advocate appearing for the petitioners submits that the petitioners have been falsely implicated in connection with the instant case and they are in custody for about 951 days. Prosecution, till date, has been able to examine very few witnesses. As such, petitioners may be released on bail. Learned advocate appearing for the State, on the other hand, opposes the prayer for bail and emphasises on the criminal antecedents of the present petitioners. It has also been submitted that after the investigation being handed over to the CID, materials have been unearthed and subsequently charges framed, evidence has commenced and three witnesses have already been examined. 2 Having regard to the antecedents of the present petitioners, I am not inclined to release the petitioners on bail. As such, the prayer for bail of the petitioners is rejected. Petitioners will renew their prayer for bail after the evidence of the vulnerable witnesses is over. Report submitted by the learned advocate appearing for the State be kept with the record. The application for bail, being CRM (M) 1505 of 2026, is, thus, disposed of. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
