2. At the outset, learned counsel for the parties submit that the issue involved in the present writ petition stands squarely covered by the judgment rendered by this Court in WPC No. 2374 of 2026 (Sushil Daga vs. State of Chhattisgarh and others) decided on
27.07.2026. It is jointly prayed that the present writ petition may also be disposed of in terms of the observations and findings recorded therein. The relevant paragraphs of the said judgment are reproduced below:–
“6. Considering the aforesaid submissions and without expressing any opinion on the merits of the controversy, the petitioner is
directed to file a fresh application before respondent No.5,supported by an affidavit, clearly indicating the extent of land proposed to be sold, the particulars of the proposed purchaser and stating that the proposed sale is necessitated solely on account of his financial exigency and that he intends to sell only the specified portion of the land. On such application being filed, respondent No.5 shall consider and decide the same, after due verification, strictly in accordance with law, by passing a reasoned order as expeditiously as possible.
7. It is made clear that the present order has been passed in the peculiar facts of the case, considering the petitioner's
4 assertion on affidavit regarding his urgent financial requirement. This order shall not be treated as a precedent in any other case.
8. With the aforesaid observations and directions, the writ petition stands
disposed of.”
3. Since the grievance of the petitioner is identical to the one considered in WPC No. 2374 of 2026 (Sushil Daga vs. State of Chhattisgarh and others) decided on 27.07.2026, and the petitioner in the present case is also seeking the same relief, the writ petition is accordingly disposed of in terms of and in line with the aforesaid judgment.
4. No order as to cost(s). sd/- (Amitendra Kishore Prasad) Judge Vishakha
